Dear friends,

This  month, four Palestinian families are threatened with demolition of their home. Their only “crime” is that they are related to those suspected of the recent killing of a young Israeli man.   

 

HaMoked stands at the forefront of the legal battle against Israel’s punitive home demolitions and we need your help. This policy is a blatant collective punishment, negating the fundamental moral principle that an individual cannot be punished for crimes committed by others.

 

Five years ago this month, Israel renewed its practice of punitive demolitions after a ten-year moratorium. This despite doubts raised by the military itself regarding the effectiveness of punitive demolitions as a deterrent – the official rationale for the policy – as well as their morality and legality.

 

Our up-to-date timeline highlights the key legal and political developments regarding punitive demolitions from 1945 until today.  The timeline is the primary source for researchers, policymakers, journalists and all those working against these demolitions.

בימים אלה, ארבע משפחות פלסטיניות ניצבות מול האיום של הריסת ביתן על ידי הצבא. "חטאן" היחיד הוא קיומו של קשר משפחתי לחשודים בביצוע פיגוע מהעת האחרונה, בו נהרג צעיר ישראלי.

המוקד עומד בחזית המאבק המשפטי נגד הריסות בתים עונשיות על ידי ישראל. מדיניות זו מהווה ענישה קולקטיבית בוטה, המנוגדת מיסודה לעיקרון המוסרי הבסיסי לפיו אין מענישים אדם על מעשים שביצעו אחרים. 

החודש מלאו חמש שנים לחידושה של מדיניות הריסת הבתים העונשית על ידי ישראל, לאחר הקפאה שנמשכה כעשור. זאת למרות ספקות שהעלה הצבא עצמו בנוגע ליעילותן של ההריסות העונשיות לצרכי הרתעה – הצידוק הרשמי למדיניות זו – וכן בנוגע למוסריותן וחוקיותן.

 

ציר הזמן העדכני של המוקד מציג את נקודות המפתח המשפטיות והפוליטיות בתחום הריסות הבתים העונשיות משנת 1945 ועד כיום. ציר זמן זה מהווה מקור ידע ומשאב משמעותי, המשמש חוקרים, קובעי מדיניות, עיתונאים וכל אלו הפועלים נגד מדיניות זו.

Setting precedent – one case at a time

שינוי מדיניות – מהפרט אל הכלל

HaMoked ensures that every punitive home demolition is subject to judicial review. Over the past five years, we have filed dozens of petitions to Israel’s High Court of Justice against these demolition orders. In seven cases, the Court revoked the demolition orders, but focused its criticism solely on the proportionality of the demolition. The Court has refused to examine the legality of the policy as a whole. Since the military resumed punitive home demolitions in July 2014, it has demolished 52 Palestinian homes and sealed another nine – all with the Court’s approval.

HaMoked will continue its individual assistance and principled litigation until this illegal and immoral policy is halted.

 

המוקד שוקד על הבאת צווי ההריסה העונשית בפני ביקורת שיפוטית. בחמש השנים האחרונות, הגיש המוקד עשרות עתירות לבג"ץ נגד הריסות בתים עונשיות. בשבעה מקרים, ביטל בית המשפט את צו ההריסה, אך ביקורתו הופנתה רק כלפי המידתיות של ההריסה. בית המשפט מסרב עד עתה לבחון את עצם חוקיותה של מדיניות זו בכללותה. מאז חידושה של המדיניות ביולי 2014, הרס הצבא 52 בתים של משפחות פלסטיניות, ואטם תשעה נוספים – כל זאת באישורו של בג"ץ.   

 

המוקד ימשיך במתן סיוע פרטני ובפעילות משפטית עקרונית עד שישראל תשים קץ למדיניות בלתי חוקית ובלתי מוסרית זו.
