Dear friends,

Since January, Jerusalemite journalist Mustafa al-Haruf has been held in an Israeli prison under threat of deportation to Jordan, a country to which he has no connection. Mustafa was born in Algeria to a Palestinian family from East Jerusalem that returned to the city in 1999 when he was 12-years-old. Since then, he and his family have tried to obtain a residency status for him in the city, but to no avail. Today Mustafa is married to a Jerusalemite and the couple has an eighteen-month-old daughter who has permanent residency status, like her mother. Yet Mustafa still lacks any legal status in Jerusalem or elsewhere.

On January 22, 2019, Israeli police burst into Mustafa’s home in the middle of the night, as described by his wife Tamam in an interview to B’Tselem:

At 3:00 A.M., the police raided our building… our daughter Asia was really frightened by the strange men who came into our apartment. She screamed and cried and ran outside after my husband. We saw him being put in handcuffs, and Asia screamed: “Papa! papa!”…

The very day before he was arrested, Mustafa and I had gone to HaMoked to ask them to appeal the denial of our family reunification application we had filed through them when we got engaged in 2015… After the arrest, HaMoked told me Mustafa had been taken to a prison for illegal immigrants in the city of Ramle.

A week after the arrest, I managed to visit Mustafa in jail. The visit lasted half an hour, and we were kept apart by a glass partition. On the next visits, I brought Asia with me, but the wardens wouldn’t let Mustafa hold her or kiss her.

Mustafa has now been detained for four months. His only “crime” is that Israel refuses to grant him residency status. The Ministry of Interior has refused  his requests due to vague “security grounds”, basing its rejections on photographs Mustafa published to his Facebook page which showcase his photographic work.

After two lower courts rejected Mustafa’s appeals, last month HaMoked filed a request to Israel’s Supreme Court to hear Mustafa’s case. HaMoked will continue to represent Mustafa and demand that he be allowed to go home to his wife and daughter, and be granted the residency status to which he is entitled.

מחודש ינואר השנה, מוחזק העיתונאי הירושלמי מוסטפא אל-ח'רוף בכלא תחת איום בגירוש לירדן, מדינה שאין לו אליה שום קשר. מוסטפא נולד באלג'יריה למשפחה פלסטינית מירושלים המזרחית. המשפחה חזרה להתגורר בעיר בשנת 1999, כשמוסטפא היה בן 12. זה שנים ארוכות שהוא ומשפחתו מנסים להשיג עבורו מעמד תושבוּת בעיר – בו מחזיקים הוריו ואחיו – אבל ללא הצלחה. 

מוסטפא נשוי כיום לאישה ירושלמית והוא אב לפעוטה בת שנה וחצי, שתיהן תושבות קבע בעיר. אבל מוסטפא עצמו נותר מחוסר מעמד בעירו ובעולם כולו.

ביום 22.1.2019, בשעות הקטנות של הלילה, הגיעו כוחות משטרה לביתו של מוסטפא. כך תיארה תמאם, אשתו, בעדותה לתחקירן בצלם: 

בשעה 3:00 לפנות בוקר, פשטו שוטרים על הבניין שבו אנחנו גרים... בתנו אסיא נבהלה מאוד מהאנשים הזרים שנכנסו לבית שלנו. היא צעקה ובכתה ורצה אחרי בעלי החוצה. ראינו איך אוזקים לו את הידיים ואסיא צעקה: ״אבא! אבא!״...
 

ממש יום לפני המעצר מוסטפא ואני הלכנו למוקד להגנת הפרט כדי שהם יגישו ערר על דחיית הבקשה לאיחוד משפחות שהגשנו באמצעותם בשנת 2015, כשהתארסנו. חתמנו שם על כמה מסמכים. ביום המעצר הודיעו לי מהמוקד שהעבירו את מוסטפא לכלא ברמלה שמיועד למהגרים בלתי חוקיים.

שבוע אחרי המעצר הצלחתי לבקר את מוסטפא בכלא. הביקור נמשך חצי שעה וחלון זכוכית הפריד בינינו. בביקורים הבאים הבאתי איתי את אסיא, אבל הסוהרים לא איפשרו למוסטפא להחזיק אותה או לנשק אותה. זה היה קשה וכואב, גם למוסטפא ולי וגם לילדה.

מוסטפא מוחזק במעצר "לקראת גירוש" כבר ארבעה חודשים. "פשעו" היחיד הוא שישראל מסרבת לתת לו מעמד בביתו היחיד. משרד הפנים מצדיק את הסירוב בעילה חסרת השחר של "טעמים ביטחוניים", בהתבסס על מבחר תצלומים שמוסטפא פירסם בעמוד הפייסבוק בו הוא מראה את עבודתו כצלם עיתונות.

בחודש שעבר, לאחר שפניותיו לערכאות נדחו, הגיש המוקד בקשת רשות ערעור בשמו של מוסטפא לבית המשפט העליון. המוקד ימשיך לייצג את מוסטפא ולדרוש כי יוּתר לו לשוב לחיק משפחתו הצעירה, וכי יינתן לו מעמד של תושב קבע, לו הוא זכאי כבן למשפחה ילידית של העיר.
